General terms and conditions of participation in the Ploom Club program

1. Definitions:

1.1. PLOOM CLUB is a loyalty program intended for members – registered users of PLOOM CLUB. According to the rules of this program, members can collect points by participating in certain activities, get various benefits and opportunities for special offers, rewards and experiences.

1.2. PLOOM CLUB is a program implemented by JT International Zagreb d.o.o., Slavonska avenija 6A, 10 000 Zagreb (hereinafter: JTI) in cooperation with business partners. JTI engages in the import and wholesale of PLOOM brand products, including heated tobacco devices that allow the consumption of tobacco products without combustion and tobacco smoke. These products are not risk-free and are intended exclusively for adults, and their sale to minors is prohibited. JTI's products are not intended to be sold to persons who are not of legal age or who are not already smokers or users of tobacco or nicotine products, nor are they in any way promoted by JTI to such persons. In accordance with the above, PLOOM CLUB is intended exclusively for existing adult smokers or users of vape devices (electronic cigarettes) or other nicotine products.

1.3. The terms used in the following rules shall have the meanings defined herein:

GENERAL TERMS AND CONDITIONS OF PLOOM CLUB 

Means the General Terms and Conditions of Participation in the PLOOM CLUB Program, which are set out in this document. The abbreviated term "General Conditions" is also used for this document.

PLOOM CLUB

Means JTI's Loyalty Club, as defined in clause 1.1, intended for registered members or registered users of PLOOM CLUB and is based on the status of such membership with all the rules set out in the General Terms and Conditions of PLOOM CLUB.

Member

Means a person who is registered and has a user account in the JTI database in accordance with the rules published on the [email protected] website and is defined in Article 3.

Account

Means a unique user profile created on computer servers that records user data, settings and activities, the settings of which are controlled to a certain extent by the user or Member.

Area

Denotes the territory of the Republic of Croatia

Ploom Products

Means Ploom-branded products sold by JTI and/or its business partners or other retailers.

Device

Means Ploom's tobacco heating device sold by JTI and/or its business partners or other dealers. The device may designate Ploom X Advanced tobacco heating technology or another Ploom product of the same category or type and purpose as JTI in its offer.

Supplements

Means Ploom-branded products that are accessories with the Device and are necessary for its smooth operation and use, including but not limited to the power adapter, USB cable, front cover (Functional Accessories), or are intended for use with the Device and do not necessarily affect its smooth operation and use (Other Accessories).

Score

Means the points won by the members of the PLOOM CLUB based on certain activities or the occurrence of certain circumstances, expressed in numbers, which are recorded in the user account of the members and defined in Article 5.

Status

Indicates the level of status of an individual member achieved based on the number of points, as defined in Article 5.

Accommodation

These are special rights and privileges for members of the Club.

Electronic code

Means a unique combination of a series of letters and numbers generated by a computer system for the purpose of using members' points for certain benefits and is used as proof of the existence of members' points, as referred to in Article 5.

Personal code

Means a unique combination of a series of letters and numbers generated by a computer system and is recorded in the user account of each member of the PLOOM CLUB as its unique code.

Refer a friend

This means a special program within the PLOOM CLUB described in Article 6.

Employed

Means a person employed by a JTI or a person otherwise engaged in a JTI.

Business partners

Means legal entities engaged in the sale of JTI's products, i.e. Ploom products, and cooperate with JTI based on a cooperation agreement.

2. Application of the General Terms and Conditions of PLOOM CLUB

2.1. The General Terms and Conditions of the PLOOM CLUB regulate participation and membership in the PLOOM CLUB, as well as the relationship of Members to JTI and the exercise of rights based on the rules specified therein.

2.2. By joining the PLOOM CLUB, i.e. By acquiring the status of a member, a person accepts these General Terms and Conditions and the PLOOM CLUB and agrees to be bound by the rules stated in the General Terms and Conditions and the PLOOM CLUB.

2.3. Members are obliged to comply with the General Terms and Conditions of Use of the PLOOM CLUB. If a Member does not agree with the General Terms and Conditions of PLOOM CLUB or is unable to comply with them for any reason, membership may be cancelled in the manner described on  the [email protected] website  and the Members' user account or by contacting JTI or Ploom Care customer service (e-mail address: [email protected] toll-free number: 0800 2026)

2.4. The General Terms and Conditions of the PLOOM CLUB are valid in the Territory.

2.5. JTI has the right to change the General Terms and Conditions of the PLOOM CLUB, as well as the services and Benefits of the PLOOM CLUB program at any time at its own discretion, of which it will inform the Members in a timely manner. The reasons for changes to the General Terms and Conditions of PLOOM CLUB may be changes in the manner of provision of services, changes in the way JTI operates, or compliance with legal changes and regulatory obligations. If the Member does not agree with such changes, he/she may terminate the membership in the manner specified in Article 2.3

3. Membership

3.1. A member of the PLOOM CLUB may become a natural person who is:

(i) Is of legal age or at least 18 years of age,

(ii) Smoker or user of vapes (electronic cigarettes) or other nicotine products;

(iii) It is located in the territory of the PLOOM CLUB.

In case of failure to meet any of the above conditions, a person cannot become a member. Legal entities, business entities, and other forms of associations do not meet the conditions for membership.

3.2. Membership in the PLOOM CLUB program is linked to the Territory. Membership in the PLOOM CLUB and all rights and obligations arising from it cannot be used in another country, i.e. outside the Territory.

3.3. Membership in the PLOOM CLUB program is unique; it is realized with one User Account, and one person cannot have more than one User Account. A single person may register multiple Devices in his/her user account by following the steps specified for registering a Device on the  [email protected] or in the Members' User Accounts (Device registration) but will still have one PLOOM-CLUB membership. PLOOM CLUB membership, Benefits and/or services provided thereunder are personal in nature and cannot be transferred to third parties.

3.4. The persons mentioned in point 3.1 become PLOOM CLUB Members by registering in the PLOOM system in the following ways:

  • By creating a user account on the website [email protected]
  • By creating a user account at Ploom product points of sale with the help of sales staff through platforms and equipment managed by sales staff.

3.5. Members are obliged to ensure that the information in their personal user account is true, accurate, and complete and represents their personal data. Members are familiar with JTI's Privacy Policy Published on [email protected] website. Members are obliged to keep their data accurate and up-to-date and are obliged to change it in their User Account in case of any changes to the data. If due to incorrect or incomplete data entered in the User Account, the Member cannot exercise any right in accordance with these General Terms and Conditions; JTI does not bear responsibility.

3.6. Membership in the PLOOM CLUB is permanent, i.e. it lasts until the termination of the Member's status at the initiative of the Member, as described in these General Terms and Conditions of the PLOOM CLUB or at the initiative of JTI. JTI has the right to refuse registration of membership, as well as to terminate the right to membership, Members' User account or use of PLOOM CLUB  when there are justified reasons for doing so, including violation of the General Terms and Conditions of PLOOM CLUB, as well as to completely terminate the PLOOM CLUB program for justified reasons, of which Members will be notified in advance in a timely manner. For additional information and complaints in case of disagreement with the decision to refuse registration, registration or termination of membership, the Member may contact JTI at [email protected]. After considering the objection, JTI will notify the Member of its decision within 15 days.

4. Benefits

4.1. By virtue of their membership in the PLOOM CLUB program and by virtue of their Status, persons are entitled to various Benefits specified in these General Terms and Conditions. JTI has the right to change the marked Benefits, the PLOOM CLUB Rules, and the General Terms and Conditions of Use of PLOOM CLUB at any time from the notice given to the changes on the [email protected] website.

4.2. The offer of Benefits based on membership in the PLOOM CLUB is valid until these General Rules of the PLOOM CLUB are amended or terminated, unless otherwise decided for individual Benefits. JTI reserves the right to:

 

  • terminate relationships with business partners and access to Benefits provided by business partners for any reason and at any time; And
  • Change the Benefits for any reason and at any time.

JTI will notify Members of any such change by posting it on [email protected] website or by email.

4.3. Members can earn Benefits by accumulating points and achieving certain Statuses based on accumulated points. The methods of earning points and different Statuses are specified in Article 5. Members may choose the Benefits listed in the PLOOM CLUB rules, subject to availability.

4.4. Members may receive Benefits only in person, except in cases where the rules of the PLOOM CLUB prescribe otherwise, i.e. so that other people can get them as well.

4.5. Certain Benefits acquired based on the Status may be realized, i.e., to be used during the period in which such Status lasts. Also, certain fees may be used within the period specified for the validity of such fee, if applicable. If a certain Benefit is not used within the specified period or period, the Member loses the right to use and exercise that Benefit.

4.6. Some Benefits may be provided by Business Partners. Business Partner benefits may be subject to agreements between JTI and Business Partners, the Business Partner's general terms and conditions, or the availability of benefits with Business Partners. JTI will make reasonable efforts to ensure the availability of such benefits but will not be liable for the failure of Business Partners to provide such Benefits, except to the extent that such failure was caused by JTI. In such a case, JTI's liability is limited to the corresponding Benefit of equal value.

4.7. JTI reserves the right, with notice to Members on the website of [email protected] or otherwise, independently or in cooperation with business partners, determine and provide Members with other Benefits not specifically specified in these General Terms and Conditions of Use of PLOOM CLUB, including but not limited to special offers, prizes, gifts, participation in events or other services not specifically specified. Also, JTI Business Partners, based on their general terms and conditions, may offer additional Benefits and special offers (such as Devices at the best prices) to PLOOM CLUB Members.

4.8. In the event that Members, through social networks or other means of communication, share content about JTI products, PLOOM CLUB rules or Benefits obtained on the basis thereof, Members are solely responsible for the content of such communications, and such communication must not be contrary to JTI's views on the properties of JTI products and their purpose, as well as applicable regulations.

5. Points and Statuses

5.1. Members of the PLOOM CLUB program could earn points for certain activities with JTI and/or business partners or subject to certain conditions and the occurrence of different circumstances, in different ways.

5.2. All earned Member points are registered and recorded in the User Account of each Member and can be used in the manner provided for in the rules of the PLOOM CLUB. Points cannot be exchanged for cash or used with any other status or loyalty program other than those set forth in the PLOOM-CLUB rules.

5.3. Points are valid and can be used in the manner prescribed by the rules of the PLOOM CLUB until the expiry of the period of two calendar years. This means that points earned at any time during the calendar year will be valid and can be redeemed until December 31 of the following year.

5.4. Points can only be received by the Member personally and cannot be transferred to other Members or third parties on any basis. In the event of the death of a member, all points and Benefits accumulated or to which the Member has acquired the right are automatically terminated.

5.5. In the event of any dispute over the right to points, the request for the exercise of the right to them must be addressed to JTI within 1 (one) year from the disputed activity or the conditions for acquisition, with the submission of evidence of such activity or condition.

5.6. The points, as well as the activities of the Members and the conditions and circumstances under which they are acquired, are listed below:

5.7. Members acquire a certain Status based on the Points earned, as follows:

1) Silver – from 0 to 1499 Points;

2) Gold – from 1500 to 2999 Points;

3) Black – 3000 and more Points.

5.8. If a Member acquires a certain Status on the basis of Points earned during one calendar year, at least that level of Status shall be maintained until 31 December of the same year, regardless of whether the number of Points required to acquire the right to a particular Status during the year is reduced on the basis of their use in the manner provided for by the rules of the PLOOM CLUB. On January 1 of each calendar year, the Member's status is again determined based on the number of Points in the Member's user account on December 31 of the previous year.

5.9. For every 500 or 1000 Points won, the Member acquires the right to use them as a form of payment (where 1 Point = 1.00 EUR) on the next purchase of any product, as follows:

 

1) At Ploom specialist points of sale and/or through specialist Ploom brand ambassadors (a list of points of sale available under the name Ploom Brand Store on the website Find a Ploom Store near you | Ploom Croatia).

2) At the point of sale of Ploom products

To use the Points in this way, Members must download the electronic codes on [email protected], i.e. to their user account (for which the value is 500.00 or 1000.00 ) for use or payment at the specified points of sale (online or offline)), and which codes will be proof of the existence of these Points and the possibility of using them for payment. In certain channels of communication between JTI and Members, the terms "coupon" and/or "coupon" may be used instead of "electronic code" to exchange Points. Such coupons or codes cannot be exchanged for monetary value.

5.10. The electronic codes specified in Article 5.9 must be redeemed within 30 days and Members must use the Benefit provided for in Article 5.9 or the Points in the manner they have chosen, within 30 days from the date of collection of the electronic code in their User Account. Otherwise, said Benefit expires, and Members lose the number of Points they then used to obtain the electronic code.

5.11. JTI reserves the right, at its sole discretion, to modify the rules and methods of earning Points or Status at any time, with prior notice to Members on [email protected] website, by amending the General Terms and Conditions of Use of PLOOM CLUB or by other notification.

6. "Refer a friend"

6.1. The Refer-a-Friend Programme Rules are the rules of the PLOOM CLUB under which any member, employee of JTI or other persons engaged in JTI (referred to in this section: the Referrer) may refer a specific person (defined in this Article 6 as: a Friend) to participate in the PLOOM CLUB, on the basis of which the Referrer and the Friend, who becomes a member of the PLOOM CLUB, acquire certain Benefits.

6.2. Each existing member of the PLOOM CLUB (Referrer) has their own personal code in their User Account, which implies a unique combination of a series of letters and/or numbers, while JTI employees and other persons engaged by JTI receive their own unique code based on JTI's business policy (hereinafter: Personal Code). The Referrer's personal code can be used as a referral code, i.e. to share with his Friend.

6.3. The conditions that must be met in total for a person to be eligible to become a Friend in accordance with the rules set out in this Article and to use the Benefits set out in these rules are:

(i) that the person concerned is of legal age or has reached the age of 18 years,

(ii) is a smoker or user of electronic cigarettes (vape devices) or other nicotine products;

(iii) be based in the territory of the PLOOM CLUB,

(iv) that he/she is not an existing member of the Ploom CLUB and that he/she did not become one at the time of using the personal referrer code,

(c) agree to become a member of the PLOOM CLUB by registering in JTI's database by creating a user account because of using the Referrer's personal code in the manner prescribed by these rules, with all the rights and obligations arising from the PLOOM CLUB.

6.4. The personal code of the Referrer who is a member of the Ploom CLUB can be used a maximum of 10 (ten) times, i.e. Benefits obtained on the basis of the "Refer a Friend" policy, both for the Member and for the Friends referred by the Member, can be used a maximum of 10 times. JTI may exclude a member from the "Refer a Friend" program now when, based on his/her personal code, 10 Benefits have been obtained under the stated program rules. In addition, JTI may exclude Friends from the "Refer a Friend" program if JTI determines  that the rules in these Terms and Conditions have not been followed, for example, if   they are the  same persons who already have User Accounts as PLOOM CLUB Members or determines that they have already used Benefits under the Program rules.

6.5. The Referrer's personal code can be used by a Friend for Benefit when purchasing a Ploom Device for the first time with the registration of a user account, in the form of a payment method or reduction of a personal payment in the amount of RSD 1,000.00 through the personal code of the Member and persons engaged in JTI, or 10 EUR through the personal code of a JTI employee, as follows:

1) At Ploom Specialist Retail Outlets and/or at a Specialist Ploom Brand Ambassador (list of points of sale available under the name Ploom Brand Store on Find a Ploom Store near you | Ploom Croatia).

3) At the point of sale of Ploom products, at the address.

6.6. The benefit mentioned in point 6.5 is achieved by showing the Referrer's personal code to the sales staff at the specified points of sale, provided that the Friend, after purchasing the Device, registers as a new Member of the PLOOM CLUB. The Referrer may make this purchase with registration under the applicable purchase policy and/or special offers with registration or membership in the PLOOM CLUB. This means that the prices of the Devices for which the Referrer's personal code can be used are determined by the merchants/business partners, and if there are special Benefits or special offers for PLOOM CLUB Members, the Friend may use these Benefits and offers when purchasing, without prejudice to the right to the Benefit referred to in point 6.5.

6.7. In the case of purchase of the Device and use of the Benefits by a Friend in the manner provided for in this Article, paragraphs 6.5 and 6.6, the Referrer will earn an additional 1,000 Points on its User Account (in accordance with Article 5), while the Benefits for JTI employees and persons engaged in JTI will be determined by JTI's business policies and decisions.

6.8. The "Refer a Friend" program may only be used for personal, non-commercial purposes, and the Referrer may share his/her personal referral code through any form of communication that can be characterized as personal communication. Mass advertising or promotion of the Personal Code and Benefits acquired from its use is not permitted and may result in immediate exclusion from the "Refer a Friend" program and/or membership in the PLOOM CLUB.

.6.10. JTI reserves the right to act regarding participation in the Refer a Friend Program to detect any abuse and to take all necessary measures to prevent or correct such abuse, including but not limited to the suspension of fees under that program.

7. Additional Warranties

7.1. In addition to the existing consumer rights guaranteed by the applicable Consumer Protection Act and the applicable Civil Obligations Act, JTI, as the importer of Ploom products for the Territory, grants its Members additional rights (hereinafter: Additional Warranty) in relation to damaged or non-functional Devices or their components or Functional Accessories that affect its proper use and operation.

7.2. The condition for obtaining the Additional Guarantee is that the Member has registered the Device in question in his/her user account according to the steps specified in [email protected] website or your User Account, before submitting a claim for the exercise of rights under the Additional Warranty or when submitting the same request.

7.3. Devices for which the right to an Additional Warranty can be exercised are those for which, on the basis of a complaint or a request for exercising the right to an additional warranty, it has been determined that there are some of the following reasons that affect their proper use and functioning (hereinafter: non-functional Devices):

(a) accidental and unintentional damage that is not caused by mishandling or negligence (hereinafter referred to as 'Accidental Damage');

2) Defect caused by defects in materials and/or workmanship and/or design, or for reasons not caused by the actions of the consumer (hereinafter: Defect).

The causes of the non-functionality of the Device also include the stated causes of any component of the Device or functional accessories necessary for its proper functioning.

7.4. To exercise the rights under the Supplemental Warranty in the event of accidental damage, Members shall take all reasonable precautions to protect the Device or Functional Accessories necessary for their proper functioning and use in accordance with their operating instructions. No additional warranty under this article will be given in the following cases:

(i) damage caused by misuse, modification or attempted modification of the Device, or electric shock;

(ii) A device with a serial number that has been modified, erased or removed;

(iii) A device or Functional Accessory that has been disassembled, serviced, or modified in a manner not approved by JTI;

(iv) loss or theft of the Device or Functional Accessory;

(v) damage to the exterior of the Device or Functional Accessory that does not affect its functionality;

(vi) defects resulting from use with an incompatible product;

(vii) damage or malfunction caused by use not in accordance with the relevant instructions for use; e

(viii) damage or malfunction caused by normal wear and/or use.

7.5. The additional warranty that Members must obtain in the event of non-functioning Devices in accordance with the rules of this section is reflected in the mandatory replacement of the Device within 2 (two) years of the purchase of the Device (with the limitation of the right to only one replacement in the event of accidental damage), which, at the request of the Members, will be carried out by service points and appointed by JTI (hereinafter:  Service points. If any of the above causes of non-functionality are found in the Functional Accessories for the Device on which its proper functioning and use depends, the replacement will be made only in connection with these Functional Accessories, if this ensures the continued proper functioning and use of the Device.

7.6. The service points designated by JTI are specialized points of sale (Ploom brand outlets, the list is available under the name Ploom Brand Store on the Find a Ploom Store near you | Ploom Croatia).

7.7. Members may address their questions and requests regarding the exercise of rights under the Additional Warranty to Ploom Care customer support (e-mail address: [email protected],  toll-free number: 0800 2026) or directly to the staff at the Service Points. To exercise the rights from the Additional Guarantee, i.e. replacement, Members will certainly be directed to Service Points.

7.8 In the event of a complaint or a claim to exercise rights under the Additional Warranty, Members are obliged to comply with the requirements prescribed by the Complaint Handling Policy and provide the following information to the competent persons of Ploom Care Customer Support or Service Points: (1) the serial number of the malfunctioning Device; (2) a description of the error, problem, or cause of the failure of the Device or Functional Attachment; and (3) actions taken before problems were initiated with the Device or Functional Accessory and any steps taken to resolve the problem.  A non-functional Device or Functional Accessory must be delivered to the Service Point, and at the request of the competent persons of the Service Points or JTI, the Member is obliged to provide proof of purchase of the Device or Functional Accessory.

7.9. The competent persons of the Service Point or Ploom Care Customer Support shall confirm in writing to the Member about the receipt of a complaint, complaint or request for the exercise of rights under the Additional Warranty. As a rule, a decision on the request, complaint, or claim will be made within 15 days of receipt. Within this period, the Member will be notified of the response in writing, or electronically by the staff of the Service Point or JTI or Ploom Care customer support. If the Member is entitled to a replacement Device or Functional Accessory, the Service Point staff will deliver it as soon as possible, no later than 15 days from the submission of the complaint.

7.10. In the case of the right to replacement under this Article, the Member shall hand over the non-functional Device or Functional Accessories subject to replacement to the staff of the Service Point, and in return shall receive a Device or a Functional Accessory of the same type, if available, or a Device or a Functional Accessory that is equivalent in performance and functionality to a non-functional Device or a replaced Functional Accessory and enables their proper functioning.

7.11. The rights under this Article provided by the additional guarantee do not affect the rights of consumers and legal remedies provided for by the Consumer Protection Act and the Civil Obligations Act, and consumers retain all legal rights they have under the applicable regulations against the merchants from whom they purchased Ploom products

 8. Other benefits

8.1. PLOOM CLUB members are also entitled to other Benefits, including:

- free cleaning of the Device, instructions and customer support at specialized Ploom points of sale (the list is available under the name Ploom Brand Store at website Find a Ploom Store near you | Ploom Croatia).

8.2. In accordance with Article 4, JTI reserves the right, with notice to the Members, to  [email protected] website or otherwise, independently or in cooperation with business partners, establish and provide its members with other Benefits not specifically specified in these General Terms and Conditions and PLOOM CLUB, including but not limited to special offers, prizes, gifts, participation in events or other services not specifically specified.

9. Final provisions

9.1. Members may cancel their membership at any time, at PLOOM CLUB , by delivering a notice of termination of membership or termination of the contract or a request for deletion of user account data sent to the JTI or Ploom Care Customer Service on (E-mail address in the: [email protected])

 

Membership terminates 30 days after the delivery of the Member's notice of termination or termination.

9.2. In the event of a breach of these General Terms and Conditions of PLOOM CLUB, JTI may terminate the membership of any Members. For further information and objections, please refer to the event of disagreement with such a decision. The Member can contact JTI at [email address]. After considering the complaint, JTI will inform the Member of the Your Decision within 15 days.  If the Member is still not satisfied with the resolution of the complaint, out-of-court dispute resolution mechanisms are available to it such as Mediation Centre at the Croatian Chamber of Economy (https://www.hgk.hr/centar-za-mirenje/zastita-potrosaca). 9.3. To exercise the rights of Members in accordance with these General Terms and Conditions, it is necessary to provide information in the User Account completely and accurately. If incomplete or incorrect information is provided in the User Account, this may be the reason why the Member will not be able to exercise some rights.

9.4. Upon termination of membership, the Member will no longer be entitled to the services and Benefits of the PLOOM CLUB program, except for the rights set forth in the Additional Warranty described in Article 7, which shall remain in force until the expiry of the terms and conditions set forth in that Article. If the right to a particular Benefit has already been exercised, the Member reserves the right to exercise it within the deadlines provided for the use of a particular Benefit, if applicable.

9.5. JTI will confirm to its Business Partners, in a manner mutually agreed, that Members and/or other persons are entitled to certain Benefits under the rules of the PLOOM CLUB and will make reasonable efforts to obtain them.

9.6. Members are solely responsible for all tax or other liabilities incurred because of membership or use of PLOOM CLUB Benefits, except for those for which JTI is solely responsible under applicable regulations.

9.7. Nothing in this article affects liability that cannot be excluded on the basis of applicable legal regulations.

9.8. JTI determines the rules for collecting Points as well as the rules for the use of Benefits and manages Points in accordance with these General Terms and Conditions. Members are entitled to use Points and Benefits in accordance with these General Terms and Conditions of PLOOM CLUB. The risks associated with the Benefits are transferred to the Members as soon as they have used the Benefit. The collection of Points and Benefits is determined by JTI at its sole discretion.

9.9. Unless JTI expressly states otherwise for a particular Benefit in writing, Points and Benefits cannot be exchanged for money, nor can they be returned or exchanged. Points and Benefits may not be purchased, sold, exchanged, or otherwise transferred to any third party, including any other Member, at any time unless specifically authorized by JTI. JTI may void all Points and Benefits that are traded or transferred in the manner described.

9.10. As set forth in clause 9.2, JTI may suspend or terminate a particular right of a member or the right of any person exercising a particular right who is suspected of using PLOOM CLUB in a manner that is inconsistent with these Terms and Conditions or applicable laws. For additional information and objections in case of disagreement with such a decision, the Member may contact JTI at [e-mail address]. After considering the objection, JTI will notify the Member of its decision within 15 days.   In addition to suspending or terminating the right to use the PLOOM CLUB program, JTI reserves the right to take appropriate administrative and/or legal action at its own discretion.

9.11. Membership in the PLOOM CLUB program is free of charge and is carried out as determined by these General Terms and Conditions.

9.12. All other information about the PLOOM CLUB program can be obtained by contacting JTI or Ploom Care customer service (e-mail address: [email protected], toll-free number: 0800/2026).

9.13. Any questions or disputes related to the right to use the PLOOM CLUB software and application, the availability of the Benefits or the acceptance of these General Terms and Conditions shall be resolved by JTI at its sole discretion, considering all allegations and evidence of the Member or the consumer. For additional information and objections in case of disagreement with such a decision, the Member may contact JTI at [email protected]. After considering the objection, JTI will notify the Member of its decision within 15 days.  

9.14. JTI's notices under these General Terms and Conditions of PLOOM CLUB can be submitted on the website [email protected] or in writing, including e-mail.

9.15. These General Terms and Conditions of PLOOM CLUB are subject to the laws of the Republic of Croatia, and all disputes related to these Terms and Conditions are subject to the jurisdiction of the court in Zagreb.

9.16. If any of the provisions of these General Terms and Conditions of PLOOM CLUB are declared invalid or unenforceable by any competent authority or court, such provision, to the extent found to be invalid or unenforceable, shall be deemed to be severable from the other provisions and shall not affect the validity of the other provisions of these General Terms and Conditions.

9.17. In the event of any discrepancies between the Croatian and English versions of these General Terms and Conditions, the Croatian version of these General Terms and Conditions shall prevail.
